CRIMINAL LAW STUDY ON ONLINE FRAUD MODE THROUGH WHATSAPP APPLICATION

The development of information and communication technology has had a significant impact on people's lives, especially in the field of transactions and social interaction through electronic media. However, this progress also opens up opportunities for criminal acts, one of which is the crime of online fraud. Online fraud is increasingly rampant with various modus operandi that utilizes social media and instant messaging applications, causing losses to the community and its own challenges for law enforcement officials. This study aims to analyze the forms of modus operandi of online fraud crimes in Cirebon City and examine the legal basis used in handling online fraud crimes by law enforcement officials. This research uses a normative juridical paradigm with a legislative, conceptual, and case approach. The type of research used is normative legal research supported by limited empirical data as a complement, with primary, secondary, and tertiary legal materials that are analyzed qualitatively.
The results of the study show that online fraud in Cirebon City has various forms of modus operandi, including online buying and selling fraud, investment fraud, online arisan fraud, and fraud on behalf of certain institutions or parties. These modes are generally carried out by utilizing the victim's trust through electronic media, especially instant messaging applications and social media. In their law enforcement practice, law enforcement officials still use the provisions of Article 378 of the Criminal Code (KUHP) as the basis for ensnaring perpetrators, with consideration of the efficiency of proof and the ease of application of the law. In addition, the use of the Electronic Information and Transaction Law (ITE Law), which has been updated in 2024, still faces obstacles, especially related to proving elements of delicacies that require expert involvement. Therefore, law enforcement against online fraud crimes in Cirebon City tends to combine conventional criminal law with the provisions of cyber law selectively. Based on the results of the study, it can be concluded that handling online fraud crimes in Cirebon City requires strengthening regulations, increasing the capacity of law enforcement officials, and public legal awareness so that efforts to prevent and counter online fraud crimes can run optimally and fairly.
